Welcome to RDPStack (“RDPStack”, “we”, “our”, “us”). By purchasing or using our Windows VPS services (“Services”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree with these Terms, you must not use our Services.

1. Services Overview

RDPStack provides cloud-based Windows Virtual Private Server (VPS) hosting solutions. Each VPS is provisioned as an isolated virtual machine intended for individual customer use.

We do not guarantee suitability for any specific workload, trading strategy, automation process, or business operation. Customers are responsible for selecting appropriate plans.

2. Account Responsibility

By using our Services, you agree to:

Provide accurate billing and contact information

Maintain confidentiality of login credentials

Accept full responsibility for all activity on your VPS

Ensure compliance with all applicable laws

You are fully responsible for software installed and actions performed on your server.

3. Acceptable Use Policy (Strict Enforcement)

You may NOT use RDPStack services for:

Sending spam or unsolicited bulk email

Phishing or fraudulent schemes

Malware, ransomware, or spyware distribution

Brute-force attacks, scanning, hacking attempts

DDoS attacks or participation in botnets

Hosting illegal content

Financial fraud

Any illegal activity under applicable law

Violation may result in:

Immediate suspension

Immediate termination

No refund

Reporting to relevant authorities

We reserve the right to investigate suspected abuse without prior notice.

4. Shared Infrastructure & Resource Usage

RDPStack operates on shared cloud infrastructure.

While each VPS is isolated:

CPU resources are shared at the hardware level

Excessive or abusive usage may trigger throttling

Sustained abnormal load may require plan upgrade

We reserve the right to suspend services that threaten node stability or infrastructure integrity.

5. No Performance Guarantees

We strive to provide stable performance, but we do not guarantee:

Specific CPU performance benchmarks

Trading latency outcomes

Profitability of trading or automation strategies

100% uptime

Infrastructure outages, network interruptions, or third-party provider issues may occur.

6. Payments & Billing

All services are prepaid.

Failure to pay by the due date may result in:

Suspension

Permanent deletion after grace period

Promotional pricing applies only for the initial billing period unless otherwise stated.

We reserve the right to change pricing at renewal.

7. Refund Policy

Due to instant provisioning and resource allocation:

Refunds are generally not provided after VPS deployment

Refund requests are evaluated at our discretion

Abuse-related suspensions are not eligible for refunds

Chargebacks filed without first contacting support may result in permanent account termination and blacklisting.

8. Data Responsibility & Backups

Customers are solely responsible for:

Backups

Security configurations

Antivirus protection

Software updates

RDPStack is not liable for:

Data loss

Corruption

Malware infection

Compromised accounts

User misconfiguration

9. Infrastructure & Third-Party Providers

RDPStack operates using third-party cloud infrastructure providers.

We are not responsible for:

Data center outages

Network disruptions

Regional connectivity issues

Provider-level suspensions

While we aim for high uptime, no hosting service guarantees uninterrupted availability.

10. Service Suspension & Termination

We reserve the right to suspend or terminate services without prior notice if:

Terms are violated

Abuse complaints are received

Legal obligations require action

Payment fails

Termination for abuse does not qualify for refund.

11. Trading & Financial Use Disclaimer

RDPStack provides hosting infrastructure only.

We are not responsible for:

Trading losses

Platform errors

Broker issues

Bot malfunction

Financial decisions made using our infrastructure

All financial activities are at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law:

RDPStack shall not be liable for:

Indirect damages

Loss of profits

Trading losses

Business interruption

Loss of data

Our total liability shall not exceed the amount paid for the affected service during the previous billing cycle.

13. Indemnification

You agree to indemnify and hold harmless RDPStack from any claims, damages, or liabilities arising from your use of the Services.

14. Modifications

We may update these Terms at any time.

Continued use of Services constitutes acceptance of updated Terms.

15. Governing Law

These Terms shall be governed by the laws of the Federal Republic Of Nigeria and The USA.

Any disputes shall be resolved in the appropriate courts of that jurisdiction.
